Welcome to Kai Photography. By accessing this website, booking a photography session, purchasing prints or digital images, or accessing a client gallery, you agree to these Terms of Service.
If you do not agree with these terms, please do not use this website or its services.
Copyright Ownership
All photographs, images, graphics, text, and other content created or displayed by Kai Photography are protected by copyright and other applicable intellectual property laws.
Unless otherwise agreed in writing, Kai Photography retains full copyright ownership of all photographs and creative works produced during any photography session.
Purchasing photographs, prints, or digital files does not transfer copyright ownership to the client.
Personal Use License
Clients who purchase photographs or receive digital image downloads are granted a non-exclusive, non-transferable license for personal use only.
Personal use includes:
Printing photographs for personal display
Sharing photographs with family and friends
Posting photographs on personal social media accounts
Commercial use, advertising, resale, publication, business promotion, contests, licensing, or any other revenue-generating use is prohibited without prior written permission from Kai Photography.
Image Alteration and Editing
Photographs delivered by Kai Photography are considered finished artistic works.
Clients may not alter, edit, manipulate, heavily crop, apply filters, use AI enhancement tools, remove watermarks, or otherwise modify delivered images without prior written permission.
RAW files are not provided, sold, licensed, or delivered under any circumstances.
Artificial Intelligence Restrictions
Photographs created by Kai Photography may not be:
Uploaded to AI image generators
Used to train artificial intelligence or machine learning systems
Used to create synthetic or derivative AI-generated content
Included in datasets used for automated image generation, recognition, or model training
Any AI-related use requires prior written permission from Kai Photography.
Portfolio and Website Content
All photographs displayed in portfolios, galleries, blog posts, or other areas of this website remain the property of Kai Photography.
Visitors may not copy, screenshot, download, reproduce, distribute, publish, sell, or otherwise use portfolio images without prior written permission.
Unauthorized use of website content may result in legal action where permitted by law.
Client Galleries
Client galleries may be provided through Pixieset or other online delivery platforms.
Gallery availability is not guaranteed indefinitely. Galleries may be removed or archived after approximately 30 days unless otherwise stated.
Clients are responsible for downloading and backing up purchased images before gallery expiration.
Kai Photography is not responsible for lost files after gallery expiration, deletion, or archive.
Prints and Digital Products
Prints and digital products are delivered as described at the time of purchase.
Color appearance may vary between screens, devices, printers, and viewing environments. Kai Photography cannot guarantee identical color reproduction across all devices or print products.
Booking and Payment
Photography services may require signed agreements, deposits, retainers, or advance payment.
Specific cancellation, rescheduling, refund, and delivery terms may be outlined separately within individual client contracts and will take precedence where applicable.
Website Availability
Reasonable efforts are made to keep this website available and functioning properly. However, Kai Photography does not guarantee uninterrupted access and is not responsible for temporary outages, technical issues, platform failures, or service interruptions.
Limitation of Liability
To the fullest extent permitted by law, Kai Photography shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of this website, client galleries, photography services, digital downloads, or print products.
Any liability shall be limited to the amount paid by the client for the applicable service or product.
Changes to These Terms
These Terms of Service may be updated periodically. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
